1. Who is responsible

The controller is CW Media GmbH, Alsterdorfer Str. 386b, 22297 Hamburg, Germany. bettrseen is a service of CW Media GmbH.

We are a small company and are not required under Art. 37 GDPR to appoint a data protection officer. The contact above handles all data protection questions.

We are a company in Germany. The EU General Data Protection Regulation (GDPR) applies to what we do, also when you live in the USA. Section 8 below adds the rights that apply if you live in the USA.

2. When we find your business online and email you

This part gives you the information required by Art. 14 GDPR.

• What data: the name of your business, its address, phone number and website, the business email address, the name of the owner or contact person if it is public, and public facts about your business online, such as directory listings, the number of reviews and your rating. We also store what AI tools answered to typical questions about businesses like yours.
• Our sources: public sources only. That means your website, public business directories, search results and the answers of AI tools.
• Why: to check whether AI answers name your business, and to send you one email, to your business email address and about a matter relevant to that business, with a personal link to the result, plus up to 2 short reminders.
• Legal basis: Art. 6 (1) (f) GDPR. Our legitimate interest is to offer our service to businesses by direct marketing, limited to publicly published business contact data and to a message about that business's own online visibility.
• Your personal link: the link in the email contains a random code. It belongs to your business. Only people who have the link can open the report page. Search engines are told not to list it.
• How long we keep it: if you do not reply and do not open the report, we delete the report and your contact data 90 days after our last email.
• You can say no at any time: you have the right to object to direct marketing (Art. 21 (2) GDPR). Use the unsubscribe link in any email, the unsubscribe page, or write to us. We then add your email address to a block list, so we never email you again. We keep this block list only for that purpose (Art. 6 (1) (c) and (f) GDPR).

3. When you visit this website

This part gives you the information required by Art. 13 GDPR.

Server logs

When you open a page, our hosting provider stores technical data: IP address, date and time, the page, browser type. We need this to deliver the site and keep it safe. Legal basis: Art. 6 (1) (f) GDPR. We delete logs after 7 days.

Free check and order forms

To request your free check, place an order or contact us, you give us your name, business email, business name and, if you choose, your phone number. We also store the time, the code of your report link if you have one, and a shortened IP address (the last part is removed).

• Why: to give you the check, report or reply you asked for and to keep a record of it. Legal basis: Art. 6 (1) (b) GDPR (you asked for it) and Art. 6 (1) (f) GDPR (record keeping).
• Contact by phone or a follow up offer: only if you tick the box or give us your phone number for that purpose. Legal basis: your consent, Art. 6 (1) (a) GDPR. You can withdraw it at any time by email. The withdrawal does not affect what we did before.
• Do you have to give us this data? No. But without name and email we cannot give you the check, the report or a reply.
• How long we keep it: 24 months after your last contact with us, or until you ask us to delete it, unless the law says we must keep it longer, for example invoices for tax purposes.

Cookies

We use two kinds of cookies.

• Necessary cookies. One cookie saves your cookie choice. One cookie unlocks your report after you fill in the form. These are needed for the service you asked for (§ 25 (2) no. 2 TDDDG, Art. 6 (1) (f) GDPR). They last up to 6 months (choice) and 30 days (report).
• Marketing cookies. Only if you click "Accept all" or turn them on in the settings. Legal basis: your consent (§ 25 (1) TDDDG, Art. 6 (1) (a) GDPR). You can change your choice at any time with the "Cookie settings" link at the bottom of each page.

With your consent we use:

• Meta Pixel by Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, Ireland. It helps us see if our ads work and show our ads to people who visited our site. For the collection and transfer of the data, we and Meta are joint controllers (Art. 26 GDPR). Meta's privacy policy: facebook.com/privacy/policy.
• Google Ads remarketing by Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland. Same purpose. We use Google Consent Mode: without your consent, no Google cookies are set. Google's privacy policy: policies.google.com/privacy.

On report pages we do not pass the personal code of your link to Meta or Google. They only see "/r".

4. Who we share data with

We use service providers who work for us under a contract (Art. 28 GDPR):

• Hosting of this website: Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, USA.
• Email sending: Resend, Inc., 2261 Market Street #5039, San Francisco, CA 94114, USA.
• AI services to create the check and the report: OpenAI, L.L.C., San Francisco, CA, USA (with and without live web search) and DeepSeek, Hangzhou, China. They get the questions we ask, which include your business type and your city, and sometimes your business name. They do not get your email address.
• Payment: Paddle.com Market Ltd, Judd House, 18 to 29 Mora Street, London EC1V 8BT, United Kingdom, when you pay for the setup or the monthly plan. Paddle is the merchant of record for your purchase and processes your payment, invoice and tax under its own privacy notice at paddle.com/legal/privacy.

With your consent, Meta and Google get data as described above.

5. Data outside the EU

Some providers named above are in the USA, the United Kingdom or China. For providers certified under the EU-US Data Privacy Framework, the EU Commission decided on 10 July 2023 that the level of protection is adequate (Art. 45 GDPR). The United Kingdom also has an adequacy decision from the EU Commission. For providers in China and any US provider without that certification, we use the EU Standard Contractual Clauses (Art. 46 GDPR) together with the additional safeguards they require. You can ask us for a copy.

6. No automated decisions

The score in your report is made by software. It has no legal effect on you and is not a decision about you in the sense of Art. 22 GDPR.

7. Your rights under the GDPR

• See the data we have about you (Art. 15)
• Correct wrong data (Art. 16)
• Have your data deleted (Art. 17)
• Limit how we use it (Art. 18)
• Get your data in a common file format (Art. 20)
• Object to our use based on legitimate interest, and to direct marketing at any time (Art. 21)
• Withdraw your consent at any time (Art. 7 (3))

8. Notice for California and other US residents

This part is for people in California (CCPA as changed by the CPRA) and in other US states with similar laws. We give these rights to all US residents.

What we collect (last 12 months)

• Identifiers: name, business email, phone, shortened IP address, cookie IDs.
• Professional information: the business you work for, its address and public listings.
• Commercial information: the order you placed and the plan you have, handled for us by Paddle.
• Internet activity: pages you visit on this site and, only with your consent, data from marketing cookies.
• We do not collect sensitive personal information.

Sources, purposes and how long we keep data are explained in parts 2 to 4 above. We collect data to create and send the check and the report, to deliver a plan you ordered, to answer you, to keep our service safe and, with your consent, to measure our ads.

We do not sell your data

We do not sell personal information and we have not sold it in the last 12 months. We only share data with Meta and Google for cross context behavioral advertising if you turn on marketing cookies. You can opt out at any time with the link "Do Not Sell or Share My Personal Information" at the bottom of each page. We also honor the Global Privacy Control (GPC) signal of your browser as an opt out. We do not knowingly collect data of people under 16.

Your rights

• Know what data we have about you and get a copy
• Have your data deleted
• Correct wrong data
• Opt out of the sale or sharing of your data
• Not be treated worse because you used your rights

9. Changes

If we change this policy, we post the new version here with a new version number and date.
