Terms of Service

bettrseen is a service of CW Media GmbH ("bettrseen", "we", "us"), CW Media GmbH, Alsterdorfer Str. 386b, 22297 Hamburg, Germany. These terms are an agreement between CW Media GmbH and the business that orders our service ("you", the "customer"). They apply to businesses ordering in a trade or professional capacity, not to consumers. By ordering the free check, the setup or the monthly plan, you accept these terms.
1. What we do
The free check is an automated review of how AI answer tools describe and name your business. It is informational and does not create a paid contract.
The setup is a one time project. We work on your website and your agreed business listings for 60 days from the date you provide the access and answers we ask for. What is included is listed on the order page you confirm before payment.
The monthly plan continues that work after the setup: ongoing changes to your website and listings, and a monthly report by email. What is included is listed on the order page you confirm before payment.
2. Price and payment
The setup costs $1,000, billed once. The monthly plan costs $59, billed every month in advance. Prices are shown in US dollars and may be shown with or without tax depending on your location; the order page and your receipt show the final amount charged.
Our order process is conducted by our online reseller Paddle.com Market Ltd, trading as Paddle.com ("Paddle"). Paddle is the merchant of record for all our orders. Paddle provides all payment processing, invoicing, tax collection and customer service related to your payment, and handles refunds under our Refund Policy. When you pay, you also accept Paddle's own terms as a buyer, published at paddle.com/legal/buyer-terms. Paddle's terms govern the payment transaction itself; these terms govern the service CW Media GmbH provides to you.
3. Minimum term and cancellation
The monthly plan has a minimum term of 3 months from your first monthly charge. After the minimum term, the monthly plan continues until you cancel, and you can cancel at any time for any future month. Cancellation takes effect at the end of the billing period you already paid for; we do not prorate a partial month.
You cancel in your Paddle billing portal or by emailing our contact form. The setup is a one time purchase and has nothing to cancel once it is paid; our Refund Policy explains when a refund applies instead.
4. Refunds
Refunds for the setup and the monthly plan are handled under our Refund Policy, which is part of these terms. Statutory withdrawal or cancellation rights that apply in your country, if any, are not affected by this section.
5. What we need from you
To do the work, we need manager level access to your website, your business listings and any tool we agree to use, the answers to our setup questions, and your review of drafts within a reasonable time. If you do not give us access or answers, the 60 day setup period does not start until you do, and a delay on your side is not a delay on ours.
Where our work includes asking your customers for reviews, you confirm that you have the right to share their contact details with us for that purpose and that the request goes out in your name with your approval.
6. Results
We do the work described on your order page: specific changes to your website and listings, delivered and reported to you. Whether a named AI tool later includes your business in a given answer, and whether that leads to a specific number of calls, leads or sales, depends on factors outside our control, including the AI tool's own model, other businesses' own websites and listings, and your local market. We do not guarantee a specific ranking, a specific mention, or a specific business outcome.
7. Your content and our work
You keep ownership of your business name, brand and existing content. Once you have paid for the setup or a month of the monthly plan in full, you own the specific changes we made to your own website and listings during that period, and you keep them even if you do not continue with us afterward. We may keep and reuse our own methods, templates and know how.
With your setup, you may allow us, without naming your business, to use an anonymized version of your report or results as an example for other businesses (as on our sample report page). This is optional and you can decline it at any time by email.
8. Liability
We are liable without limit for intentional acts, gross negligence, injury to a person, and any liability that cannot be limited under mandatory law. For ordinary negligence, we are liable only for the breach of a material contractual duty (one whose fulfilment makes this agreement possible to perform at all, and on which you may rely), and in that case our liability is limited to the amount you paid us in the 12 months before the event. We are not liable for lost profits, lost business or indirect damages beyond that.
We are not liable for outages, changes or removals made by third parties we do not control, including AI answer tools, search engines, review platforms and business directories.
9. Term and termination
The setup ends when the 60 day period ends or when we deliver the day 60 report, whichever is later. The monthly plan runs from month to month after the minimum term in section 3. Either party may end this agreement for a serious breach the other party does not fix within 14 days of being asked in writing.
10. Changes to these terms
We may update these terms, for example to reflect a new part of our service or a change in the law. We post the new version here with a new date. Changes apply to charges from the date they are posted; they do not change what you already paid for.
11. Governing law and venue
CW Media GmbH is a German company, and this agreement between you and CW Media GmbH is governed by the laws of Germany, without regard to the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive venue for any dispute under this agreement is the courts of Hamburg, Germany. This choice of law and venue does not apply to your payment transaction with Paddle, which is governed by Paddle's own buyer terms, and does not take away any right you have under the mandatory law of your own country.
12. Entire agreement
These terms, the order page you confirmed and our Refund Policy make up the entire agreement between you and CW Media GmbH for the service. If a part of these terms is found invalid, the rest stays in force.
